NOTICE TO BIDDERS

TOWN OF MONTGOMERY

SALE OF STANDING HAY

Sealed proposals will be received by the Town Clerk of the Town of Montgomery, 110 Bracken Road, Montgomery, New York 12549, up to and including Tuesday, April 16, 2024 at 3:00 p.m. when the same will be publicly opened and read for the SALE OF STANDING HAY, from the former "Benedict Farm" now the lands of the Town of Montgomery, New York State Route 17K, Town of Montgomery, the specifications for which are as follows:

1. Liability insurance coverage, naming the Town of Montgomery as an additional insured and satisfactory to the Town, must be in place prior to the successful bidder's or its agents' or employees' entrance on the property.

2. The contract shall be from June 20, 2024 until September 30, 2024. The successful bidder may request to start earlier and finish later than these dates. The Town at its sole discretion, reserves the right to approve of any changes to the time frames of the contract.

3. The contract shall not include the use of any of the buildings.

4. No disturbance of the sod is permitted by the user. Additionally, no activity other than the cutting and removal of standing hay shall be permitted without the written consent of the Town of Montgomery.

5. The contract may not be assigned.

6. The Town reserves the right to access all portions of the farm at its sole discretion for all purposes other than to cut the hay.

7. If bales of hay are left in the field, they must be removed by September 30, 2024. The Town shall not be held responsible for bales of hay left on the field under any circumstance, nor shall the Town be held liable for any damage or removal of bales of hay left in the field at any time. Awardee shall bear the risk of loss of any such bales.

8. The successful bidder must pre-pay the full amount of the bid within ten (10) days of the date of the award.

9. If work proceeds on the Benedict Farm Park recreation plan, hay may not be harvested from any of the affected areas.

10. Approval by the Town of Montgomery and the NYSDEC will be required to hay the setback areas of the hayfields that abut the wetland where a threatened species of wildlife was identified.

11. Further specifications for the contract award and a diagram of the area which may be harvested are available from the Town Clerk's Office.

Any award shall be subject to the execution of an Agreement between the bidder and the Town of Montgomery, which, at a minimum, must include the specifications herein set forth.

All bidders must attach to their bids a statement of non-collusion in the manner prescribed by Section 103d of the General Municipal Law.

Acceptance of any bid is subject to the approval of the Town Board of the Town of Montgomery and all other governmental departments required by law.

The Town Board of the Town of Montgomery reserves the right to reject any and/or all bids and to re-advertise for new bids.
