What’s next for Hill Street bridge?

Nearly two months after receiving a favorable court ruling in their battle with the Town of Montgomery over the Hill Street Bridge, Walden officials are wondering what comes next.

The Orange County Supreme Court ruled in January, that the town is liable to repair or replace the century-old bridge that has been closed to vehicles for more than a decade.

At last week’s village board meeting, Trustees questioned what the next step would be, as they’ve not heard from the Town of Montgomery on the matter since the court ruling was made.

Attorney Dave Donovan said there were two aspects to the lawsuit.

“The first was a Judicial Declaration that the Town was responsible for the bridge and to pay for the bridge,” Donovan said. “We have that.

“The second was injunctive relief to compel them to begin action on the bridge immediately. Court declined to award that.”

Donovan said the attorneys utilized by the village have filed a notice of appeal, arguing that the town should be compelled to begin the repairs immediately.

“Your other option is to kind of repeat what’s been done… I have at your behest written to town I think three times over the past six years citing the law the saying they’re clearly responsible. We now have a judicial declaration to that and if you want to push - I used a sports metaphor - the full court press you are certainly free to do that you can do it by a board resolution. You can do it by board letter. “

Trustees decided it best not to discuss the legal; strategy in public. They would, instead, wait until the end of the meeting and discuss it in executive session under attorney-client privilege.
